Evidence Unit

The Mission of the Colorado State Patrol Evidence Unit is to safeguard the evidence and property in our possession with professional, purposeful decision making and processes, to ensure the best outcome for prosecution, customer service and agency integrity, preventing loss, damage and liability.

Appointments are required to ensure items are releasable. All items require a detailed approval process prior to release. Firearm releases require advance notice as a background check is required in addition to the approval. 

We are closed on weekends and holidays.

Contact the Evidence Technician that covers the district in which your incident was located or email the unit at csp.evidence@state.co.us. Please provide the Colorado State Patrol case number or the name and date of birth of the parties involved. 

Items held as “Evidence” are held until the case is fully adjudicated, including probation. Evidence is not released without authorization from the agency handling the case. This would include the investigating officer, the District Attorney, or another law enforcement agency or court. 

Items held as “Property” are releasable once ownership has been established and internal approval has been received.

The Colorado State Patrol will not return any item that would be considered illegal under State or Federal law. 

Prescription medication may be returned if it is in the original prescription bottle. The container must have the patient’s name, drug name, and cannot contain any comingled medication and cannot be expired. The owner of the prescription would need to provide a valid ID and have an appointment to pick it up.

Someone other than the owner may claim your property with a Power of Attorney (POA) or a notarized statement authorizing them to claim the item(s) on your behalf. 

If an owner is deceased, property can be claimed using a notarized JDF-999. The person picking up your property must make an appointment with the Evidence unit and bring a valid photo ID along with any required paperwork listed above. 
 

A background check is required for all firearm returns to ensure eligibility to possess. 

The “eligible” background check is required before an appointment to return them can be made. The background process typically takes 5 to 10 business days. You must contact your local Evidence Technician and provide them with the information needed to run the background check. All background checks are processed through the Colorado Bureau of Investigations. 

If you are unable to pass a background check, a case-by-case assessment will be made to determine if the firearm is eligible to transfer ownership to a third party. In some instances, firearms in Evidence Unit custody are not eligible to be transferred based on the circumstances and will be destroyed. 

A valid ID is required on any property returns.

Out-of-state residents must select an FFL (Federal Firearm Licensee Dealer/Store) to have the firearm shipped to. The shipping fee will be the responsibility of the owner. Please contact your local Evidence Technician to begin the process. 

A letter will be sent to the last known address of the listed owners of the property. Once a notice is sent property will be held for 30 days prior to donation or destruction. 

Any item turned into the Evidence Unit as found property is held for at least 6 months to attempt to identify an owner. If the item has not been claimed, it may be eligible for release to the finder under certain circumstances. Unclaimed property that has been deemed to hold no value or is considered contraband will be destroyed. Property that has been deemed valuable may be donated, converted to department use or sold at public auction per state statute CRS 42-13-103.
